RULES of the BRITISH DANCESPORT FEDERATION (“The Company”)
1 Management
The management of the Association and the control of its affairs is vested in the Board of Directors (hereinafter referred to as ‘the Board’). Except as otherwise provided in these Rules the Board is empowered to decide on matters arising from time to time and within the Memorandum and Articles of Association of the company, or to put such matters to the vote of the general membership. The Board may appoint an Administrator, who need not be a member of the Company.
2 Conflict
Where these rules conflict in any way with the Memorandum and Articles of Association, (“M & A”) the M & A shall prevail.
3 Classes of Membership
3.1 There shall be two classes of membership; ordinary or honorary. Honorary membership may be conferred upon any ordinary member by the simple majority decision of the Board
3.2 An honorary member is exempted from payment of membership fees but in all other respects has the same rights and obligations of ordinary members.
4 Application
4.1 Application for membership shall be made to the Administrator, in such form (if any) as the Board may from time to time prescribe.
4.2 Applications shall be accompanied by annual membership fees, and a joining fee (if any) which will be refunded if the application is rejected.
4.3 All memberships are subject to a provisional period of 90 (ninety) calendar days, during which time the Board in its absolute discretion may decline to confirm the full membership of any such provisional member.
4.4 Applications will be referred to the Board. An acceptance or rejection decision will be made and the applicant informed of the decision within 90 (ninety) calendar days of the date of application. There is no obligation of the Board or of the Company to give any reason for its decision.
4.5 In addition to the requirements under this rule, a license to compete will not be granted to any member wishing to compete as an Athlete until such member has submitted to the administrator their proof of date of birth, and such evidence of their residential address and citizenship as the Board may from time to time require.
4.6 No member may be elected or otherwise become a Member of the Board or the Nominating Committee, or vote in any meeting, until he/she has been a Full Member of the BrDSF for a minimum of 24 months.
5 Rights and Obligations
5.1 Each member may request a membership card be issued to him/her. The member will be notified once the card is available. This may be made available in electronic format.
5.2 Members shall abide by the M & A and these rules, and the competion rules of the WDSF, and shall conduct themselves at all times in a manner which shall not be prejudicial to the interest or objects of the Association.
5.3 Members may renew their membership without re-application by paying the annual dues before the first day of the third month of the Membership Year, which shall commence on 1st January annually.
5.4 Dispute resolution
Acceptance of these rules shall be deemed contractual as between any member and the Company. Any dispute arising from these rules, or under the M & A, shall first be referred to Alternative Dispute Resolution by a Mediator or Arbitrator whose decision shall be final. In the event of disagreement as to the choice of such Mediator or Arbitrator, such person shall be selected on a joint application to the President for the time being, of the Centre for Dispute Resolution, or of the Chartered Institute of Arbitrators . The costs of such Mediator or Arbitrator shall in the first instance be borne in the first instance by the Member but will be subject to any costs award made in the Mediation or Arbitration.
6. Fees
Annual membership fees, and joining fees ( if any) are as set by the board from time to time, and will be notified to all members and applicants for membership by the Administrator administrator.Such fees exclude any fee that may be payable separately by the member to WDSF, or to any competition organiser.
7. Termination of Membership
7.1 A member may terminate their membership by so notifying the Secretary in writing. In the event that they do so before the end of the Membership year, no part of their no part of their fee shall be refundable. However, in the event of the termination of membership by reason of the death of any member, the board may in its absolute discretion elect to rebate the unused part of any annual membership fee to the legal personal representatives of the deceased member
7.2 Membership granted in a previous Membership Year terminates on the first day of the third month of the succeeding Membership Year unless the annual fees for that Membership Year have been paid by that time.
7.3 Termination of membership may be by a simple majority decision of the Board for conduct considered to be prejudicial to the interests or objects of the Association as expressed in the M & A, or in these rules
7.4 The board may, in its absolute discretion, consider the reinstatement of any member whose membership has been terminated. Reinstatement shall be by simple majority vote of the Board.
